Your first payment will be drafted on the day you submit this membership agreement and will continue to be drafted on the same day of each following month for the duration of the membership. THE INITIAL MEMBERSHIP TERM IS THREE (3) PAID MONTHS (“INITIAL MEMBERSHIP TERM”). FOLLOWING THE INITIAL MEMBERSHIP TERM, MEMBERSHIP AUTOMATICALLY RENEWS ON A MONTH-TO-MONTH BASIS (EACH MONTH A RENEWAL MEMBERSHIP TERM) (“RENEWAL MEMBERSHIP TERM”), UNLESS CANCELLED, TERMINATED, OR SUSPENDED. You authorize SCBA Management, LLC d/b/a SCALP BAR and its successors and assigns (“Operator”) to process credit card, ACH, or any other payment method transactions according to the membership type selected. This authorization will remain in effect until this agreement is terminated, suspended, or cancelled by the process detailed below. You agree to notify the Operator where you originally purchased your membership (the “Home Shop”) of any changes to your payment information.
MEMBERSHIP CANCELATIONS CAN BE INITIATED ON SCALPBAR.COM OR BY VISITING THE HOME SHOP IN PERSON. MEMBERSHIP BENEFITS WILL CONTINUE TO THE END OF THE TERM FOR WHICH YOU PAID. CANCELLATIONS MUST BE SUBMITTED AT LEAST TEN (10) DAYS PRIOR TO THE NEXT SCHEDULED BILLING DATE. CANCELLATIONS SUBMITTED LESS THAN TEN (10) DAYS PRIOR MAY RESULT IN BEING CHARGED FOR THE NEXT BILLING CYCLE, WITH MEMBERSHIP BENEFITS CONTINUING THROUGH THAT TERM.
You acknowledge and agree that this membership agreement presents the following disclosures before you provide us with your billing information: (1) you will be charged for the membership on a monthly basis unless you timely take steps before the end of the Initial Membership Term or a Renewal Membership Term to cancel, (2) you must provide notice before the end of the 3 month initial term or each subsequent monthly renewal term, ten (10) days for processing, to avoid an additional month of charges, and (3) you have been provided with instructions on how to cancel your membership.
Unused blowout and/or scalp treatment benefits may be used up to 30 days after the termination of this agreement, except as otherwise noted herein. You will not be entitled to a refund or any other reimbursement upon the expiration of prepaid blowouts. In the event of failed payment or inappropriate conduct by you (as determined by Operator), Operator reserves the right to terminate your membership, which will be effective immediately. Unused blowout benefits will be forfeited and not refunded upon termination for inappropriate conduct or failed payment. Further, Operator may terminate or suspend your membership for violating Scalp Bar rules or the terms of this agreement (including, but not limited to, payment noncompliance). Upon suspension, all aspects of your membership will stop until and unless Operator allows your membership to resume. Unused blowout/scalp treatment benefits are not available to suspended members during the suspension period. Operator will notify you if Operator allows you to resume your membership. If so, you may be required, at Operator’s sole discretion, to execute the Home Shop’s then-current Membership Agreement, which may include different terms than those set forth herein.
Membership benefits are provided based on the specific membership type selected at enrollment. Memberships do not interchange, scalp-treatment memberships may not be redeemed for blowouts, and blowout memberships may not be redeemed for scalp treatments. Each membership type includes the following benefits:
1. Basic Scalp Treatment – 1 per month
2. Basic Scalp Treatment – 4 per month
3. Blowout – 1 per month
4. Blowout – 4 per month
Unused blowouts and/or scalp treatments rollover each month as long as your account remains active and in good standing, subject to the terms herein. Members may share unused prepaid blowouts with a companion if the member and companion schedule their appointments together at the Home Shop. Rollover credits have no cash value and will automatically expire if your membership is terminated, cancelled, or suspended. Expired credits are forfeited and not eligible for refund. Any Free Add-ons or Anniversary Gifts are subject to availability and Anniversary Gifts can only be redeemed at the Home Shop. There may be additional membership benefits as determined by the Home Shop. If you do not have any unused prepaid blowouts and/or scalp treatments at the time of service, you will pay the then-current rate for additional blowouts and/or scalp treatments based on your membership type. Documentation requirements and prices may vary (including based on location), and additional charges may apply. Except as otherwise stated herein, this membership and any prepaid blowouts and/or scalp treatments are not assignable or otherwise transferable and are personal to the undersigned.
Your appointment may be changed or cancelled without charge up to 24 hours before the appointment’s scheduled start time. If your appointment is cancelled less than 24 hours before the appointment’s scheduled start time, you may be charged a late cancellation fee of $25. If you do not arrive to your appointment without cancelling, you may be charged the full amount of the scheduled service price. Members will be charged one blowout and/or scalp treatment benefit on your membership. If no blowout and/or scalp treatment benefit is present on your account, then you will be charged the current Member price of a blowout and/or scalp treatment to the credit card on file. All applicable appointment cancellation charges will be automatically drafted from your payment method on file and are not refundable.
Subject to applicable law, Operator reserves the right to increase your monthly membership rate and additional blowout rate or otherwise modify any membership benefits upon thirty (30) days’ written or electronic notice to you. Unless you complete the proper cancellation procedures above, you will incur the increased monthly membership rate on your next monthly auto payment date following the end of the notice period. Operator additionally reserves the right to cancel, modify, or restrict this membership program or any aspect of this membership program at any time upon thirty (30) days’ written or electronic notice to you. Operator reserves the right to transfer or assign all or any part of its interest, rights, privileges, duties, and obligations hereunder to any person or legal entity without notice to you or your approval. You acknowledge and agree that this agreement shall be binding to the fullest extent permitted by Nevada law. This agreement shall be governed by and construed in accordance with the laws of the State of Nevada. Any disputes arising under this agreement shall be resolved exclusively in the state or federal courts located in Clark County, Nevada. In the event of any action concerning or arising out of this Agreement or the parties’ respective rights and obligations under this agreement, the AGENT and PURCHASER agree that the exclusive jurisdiction and venue shall lie in Eighth Judicial District Court of Nevada in and for Clark County Nevada. Each of the parties irrevocably consents to the personal jurisdiction of these courts. If any term or provision of this agreement is deemed to be invalid, illegal, or unenforceable, all other terms and provisions will remain in full force and effect and such invalidity, illegality, or unenforceability will not invalidate or render unenforceable such term or provision in any other jurisdiction. This constitutes the entire agreement between the parties and supersedes all prior or contemporaneous proposals, agreements, representations, statements, negotiations and understandings, whether oral or written, between the parties concerning the matters set forth in this agreement.
SCALP BAR is independently owned and operated by the Operator. Neither of its parents, subsidiaries, or affiliates, is the owner or operator of the Scalp Bar or a party to this agreement, nor are contractually or otherwise liable to you, the Member identified in this agreement. Please be advised your personal information (including but not limited to visit history, buying habits, personal preferences, and the contact information provided in this agreement) may be shared affiliated companies and brands, approved third-party vendors, and other SCALP BAR locations for various purposes, including but not limited to providing, maintaining, and improving services at SCALP BAR locations. By signing below, you acknowledge that your membership will automatically renew monthly until cancelled in accordance with this agreement.
